Terms and Conditions of Use
Traveling Balanced, LLC
Last Updated: March 1, 2026
These Terms and Conditions of Use ("Terms") govern your purchase and use of digital products and advisory services offered by Traveling Balanced, LLC, located at 333 E Palmetto Park Rd, Boca Raton, FL 33432 ("Company," "we," "us," or "our"). Our email is [email protected]. "You" and "your" refer to anyone who purchases, accesses, or uses our digital guides, our Planning Call, The Itinerary, VIP Planning, or Hotel Bookings service (together, the "Offerings"). These Terms are legally binding. Please read them before purchasing or using any Offering.
1. Three Kinds of Offerings
Traveling Balanced provides three distinct kinds of Offerings, and different sections of these Terms apply depending on which one you purchase or use:
Where a section below applies to only one of these, it says so directly.
2. Eligibility
You must be at least eighteen years of age, or the age of majority in your jurisdiction, to purchase or use any Offering. Use of our website and Offerings is at your own risk. These Terms may be updated at any time, and the version posted at checkout at the time of your purchase governs that purchase.
3. Digital Products
Digital guides are licensed to you for personal, non-commercial use only. You may download and use a guide for your own trip planning. You may not resell, redistribute, republish, or share a guide with anyone who has not purchased it themselves. Due to the instant, digital nature of these products, all sales are final. We do not offer refunds, returns, or exchanges on digital guides once purchased.
Some guides may include affiliate links. We may earn a commission on bookings made through those links at no additional cost to you. These commissions support the continued creation of our travel content.
4. Paid Advisory Services
Traveling Balanced offers three paid Advisory Services: Planning Call, The Itinerary, and VIP Planning. The price, deliverables, and specific inclusions for each are described at checkout. Hotel booking is included as part of The Itinerary and VIP Planning; it is not part of a standalone Planning Call. On-trip support during your travels is included only with VIP Planning; it is not included with The Itinerary or a Planning Call.
The fee for each Advisory Service is due in full at checkout and is non-refundable once purchased, regardless of whether you complete your call, receive your itinerary, or ultimately travel. Advisory Service fees are separate from, and are not a deposit toward, the cost of hotels, tours, transfers, or other travel expenses, which are billed at cost.
Rescheduling a Planning Call is available up to 24 hours before your scheduled time. Rescheduling does not extend to a refund of the fee paid.
Additional rounds of revisions beyond what is included in The Itinerary or VIP Planning, or requests that fall outside the scope described at checkout, may be arranged separately at an hourly rate.
If you purchase an Advisory Service that includes a hotel booking, you will also be asked to sign a Client Engagement & Booking Agreement, which sets out additional terms specific to that engagement and to your hotel reservation. That agreement works together with, and does not replace, these Terms.
5. Hotel Bookings and Your Role as a Traveler
Hotel Bookings is offered as a free, standalone service with no planning fee, for travelers who already know which hotel they want to book. For The Itinerary and VIP Planning, hotel booking is included as part of the paid Service. In all of these cases, Traveling Balanced sources and secures your reservation through its advisor network and confirms applicable perks directly with the hotel. Traveling Balanced is not a party to your reservation contract with the hotel, and hotels, not Traveling Balanced, are responsible for honoring reservation terms, handling on-trip issues, and administering their own cancellation and refund policies.
Hotels, airlines, tour operators, and other travel suppliers referenced in our recommendations are independent businesses and are not our employees, agents, or partners. We are not responsible for their acts, errors, omissions, cancellations, or failures to deliver services as promised. Perks such as room upgrades are subject to hotel availability and are not guaranteed even at participating properties.
6. Assumption of Travel Risk
Travel involves inherent risk. You are responsible for reviewing current entry requirements, passport and visa rules, vaccination recommendations, and safety and security conditions for your destination before you travel. For U.S. State Department advisories, visit travel.state.gov. For CDC health notices, visit cdc.gov/travel. We do not have special expertise in these areas beyond general travel knowledge, and you agree that any recommendations we provide do not replace your own research or professional advice on these topics.
You release Traveling Balanced from claims arising out of travel risks, supplier failures, natural events, or other causes outside our control.
7. Local Customs and Laws
You are responsible for following the local laws, customs, and regulations of any destination you visit. Traveling Balanced is not liable for any consequence, including detention or arrest, resulting from your failure to comply with local law while traveling.
8. Travel Insurance
We strongly recommend that you purchase travel insurance to protect your trip investment against cancellations, medical emergencies, lost baggage, or delays. If you decline travel insurance, you accept that Traveling Balanced is not responsible for financial losses resulting from trip disruptions, and that declining insurance means you risk losing some or all of your travel investment.
9. Medical and Physical Conditions; Medical Emergencies
If your trip includes physically active experiences, such as hiking, water sports, or walking tours, you are responsible for confirming that you are in suitable health to participate, and for managing any medication or medical condition during your travels. In the event of a medical emergency during a trip, Traveling Balanced will make reasonable efforts to help you connect with appropriate local resources where feasible, but is not a medical provider, cannot guarantee the quality or availability of medical care at your destination, and is not responsible for the cost of any medical treatment you receive. Travel insurance, as described above, is the appropriate way to protect yourself against these costs.
10. Reviewing Your Reservation
If Traveling Balanced books a hotel on your behalf, whether through Hotel Bookings, The Itinerary, or VIP Planning, you are responsible for reviewing your reservation confirmation immediately upon receipt, for tracking the cancellation and refund deadline set by the hotel, and for giving Traveling Balanced written notice at least 48 hours before that deadline if you want to change or cancel. Full detail on this responsibility is set out in your signed Client Engagement & Booking Agreement, where applicable.
11. Intellectual Property
All text, images, designs, and materials on our website and in our digital guides are owned by Traveling Balanced or properly attributed to their source. You may not reproduce, republish, or redistribute this content, in whole or in part, on another website or social platform without our written consent. You may download and personally use guide content you have purchased, but you may not resell it, claim it as your own, or distribute it to anyone who has not purchased it.
12. Your Materials and Contributions
If you submit a comment, photo, review, or other content to us or on a platform we maintain, you grant us a non-exclusive, commercial license to republish that submission in whole or in part, unless you tell us in writing that we may not. Please do not submit content that is unlawful, hateful, or otherwise harmful.
13. Model Release and Marketing Materials
If you submit a photo, video, or testimonial to Traveling Balanced, whether as part of a review, a tagged social media post, or a submission you provide us directly, you confirm that you own the rights to that image or otherwise have the right to grant us permission to use it. Traveling Balanced may also use statements you make about your experience, and photos or images you share with us from your trip, in our marketing materials, website, and social media, without additional compensation to you. You may withdraw this permission at any time by emailing us, though we are not obligated to remove content already published before your request.
14. Reviews
If you leave a review of a purchased Offering, it should reflect a genuine experience, avoid offensive or discriminatory language, and not misrepresent your use of the Offering. We may decline to publish a review at our discretion. By submitting a review, you grant us a license to reproduce and display it in connection with our marketing.
15. Confidentiality
You do not have a general right to confidentiality simply by using our website or purchasing a digital guide. If you engage us for a Planning Call, The Itinerary, or VIP Planning, the Client Engagement & Booking Agreement you sign at that time provides you with confidentiality protection for the personal and trip-related information you share with us during that engagement. This protection does not prevent Traveling Balanced from sharing necessary trip details, such as your name, travel dates, and preferences, with hotels and other suppliers as needed to complete and confirm your booking.
16. Communications
Messages sent to us through our contact page, email, or social channels are not treated as privileged or confidential except as described in Section 13. Please refer to our Privacy Policy for how we store and use information you provide us.
17. Disclaimers
Our website, guides, and Advisory Services are provided for informational and planning purposes. We make reasonable efforts to keep information accurate and current but do not guarantee that all content is complete or error-free. If you have medical, legal, or financial questions related to your travel, consult the relevant licensed professional. Individual outcomes and experiences vary, and any past client experiences we reference are not a guarantee of your results.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR OFFERINGS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT ANY WEBSITE, GUIDE, OR SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
To the fullest extent permitted by law, Traveling Balanced is not liable for any accident, injury, illness, or death arising from your travel, including travel booked or coordinated through our Advisory Services. This is in addition to, and does not limit, the assumption of travel risk described in Section 6.
Our website and checkout are supported by third-party platforms, including Flodesk. While we take reasonable care in choosing reliable providers, we are not responsible for outages, errors, or failures caused by these third-party platforms, except in cases of our own gross negligence.
18. Independent Contractor Relationship
Traveling Balanced is not your employee or your agent for purposes of booking travel, except to the limited extent needed to confirm hotel perks on your behalf. Suppliers, including hotels, are independent businesses, not our subcontractors or partners.
19. Host Agency Relationship and Seller of Travel Disclosure
Karissa operates Traveling Balanced as an independent contractor advisor hosted by Fora Travel ("Fora"), a host travel agency. Fora provides accreditation, supplier relationships, and administrative support to independent advisors like Karissa, but this is not an employee, partner, or agent relationship, and Fora does not control the day-to-day recommendations or business practices of Traveling Balanced. Bookings made through Traveling Balanced may be processed using Fora's accreditation and supplier agreements. Fora is a registered Seller of Travel in the State of Florida. Fora is not the direct provider of your travel services and is not responsible for the acts, omissions, or performance of third-party suppliers such as hotels, airlines, or tour operators.
20. Limitation of Liability
To the fullest extent permitted by law, Traveling Balanced, and Karissa individually, will not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of our Offerings, including lost profits, lost bookings, or personal injury connected to your travel. Where liability cannot be excluded entirely, our total aggregate liability to you for any claim arising out of a Planning Call, The Itinerary, or VIP Planning is limited to the amount you paid us for that specific Service. This cap does not apply to amounts you paid directly to hotels or other suppliers, which are governed by your agreement with them. Nothing in these Terms is intended to waive, limit, or exclude any liability that cannot be waived under applicable law.
21. Indemnification
You agree to indemnify and hold harmless Traveling Balanced, Karissa, and any contractors we work with, from claims, damages, and expenses, including reasonable legal fees, arising out of your misuse of an Offering, your violation of these Terms, or your failure to meet the responsibilities described in Section 8 or your Client Engagement & Booking Agreement. This indemnification does not apply to claims arising from Traveling Balanced's own professional negligence, errors, omissions, or willful misconduct.
22. Force Majeure
Traveling Balanced is not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, government action, war, civil unrest, epidemic, or supplier or telecommunications failures.
23. Payment and Pricing
By purchasing a digital guide or Advisory Service, you authorize us to charge your selected payment method, processed securely through our checkout provider, Flodesk, and its integrated payment processor. We do not store full card numbers. You are responsible for keeping your payment information current. We reserve the right to correct pricing errors, even after payment, and will notify you in writing if a correction affects your order. Prices for new purchases may change at any time; your price is locked in at the time of purchase. We are not able to accommodate a price adjustment or partial refund on a past purchase if our prices change after you buy.
If you attempt a chargeback rather than contacting us first to resolve a billing issue, you agree that we may present proof of your purchase, use, and these Terms to your financial institution in response.
You may not purchase our Offerings for the purpose of reselling, redistributing, or operating a competing service.
24. Taxes and Currency
Payments are processed in US Dollars unless otherwise stated at checkout. Applicable sales tax will be added where required by law.
25. Termination
We may suspend or terminate your access to an Offering if we reasonably believe you have violated these Terms. If you wish to stop working with us, you may do so at any time by emailing us; any outstanding balance for Services already delivered remains due.
26. Revocation of Access; Outstanding Balances
You may stop working with Traveling Balanced at any time by emailing us. If you owe an outstanding balance, such as for additional revision rounds or other services billed at an hourly rate under Section 4, that balance remains due upon termination. Any outstanding balance not paid within 14 days of termination may be referred to collections, and you agree to be responsible for reasonable costs of collection, including attorney's fees, to the extent permitted by law.
27. Assignment
You may not assign or transfer your rights or obligations under these Terms, a Client Engagement & Booking Agreement, or any purchase, to another person without our written consent.
28. Dispute Resolution
If a dispute arises, we ask that you first contact us directly so we can attempt to resolve it informally. If we cannot reach a resolution, any dispute arising out of or relating to these Terms, a digital guide purchase, or an Advisory Service will be resolved through binding arbitration administered by the American Arbitration Association in Palm Beach County, Florida, rather than in court, except that either party may bring an individual claim in small claims court where eligible. This section does not apply to disputes arising under a separately signed Client Engagement & Booking Agreement to the extent that agreement specifies a different process.
29. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles.
30. SMS Communications Consent
If you provide your mobile phone number and opt in to receive text messages from Traveling Balanced, you consent to receive SMS communications related to our services, updates, reminders, and other business-related information. Your phone number will not be shared, sold, or disclosed to third parties for marketing purposes. Message frequency may vary based on your interactions with us. You may opt out at any time by replying STOP to any message, or reply HELP for assistance. Message and data rates may apply based on your mobile carrier's plan.
31. Entire Agreement and Severability
These Terms, together with our Privacy Policy and, where applicable, your signed Client Engagement & Booking Agreement, are the entire agreement between you and Traveling Balanced regarding the Offerings. If any part of these Terms is found unenforceable, the remaining provisions remain in full effect.
